Many spouses obtain a divorce from foreign courts, assuming that the decree will automatically be valid in India. The validity of such decrees is determined primarily under Section 13 of the Code of Civil Procedure. A foreign judgment is not conclusive if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1272103d0b8e4eb79e31694f19dd5f7d\">It is not given by a court of competent jurisdiction<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8d5eeb8f31dff5ed86ba83dee4ea05fb\">It is not given on the merits of the case<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-31064cef3f60908fd148ef310b514633\">It is based on an incorrect view of international law<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-81504b0f9cde52ecc801e8758f6d07da\">It violates principles of natural justice<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-73f8b5bf66912e225172b342d2171827\">It is obtained by fraud\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c9b8dc5d795374adf35abdc49bd9c1dd\">It is contrary to Indian law or public policy\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-f3c1da26ee6fcf42c9de2e9f870d094c wp-block-paragraph\">Therefore, registration of a foreign divorce decree in India depends on whether the decree satisfies these conditions or not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A Foreign Divorce Decree Is Not Automatically Valid in India<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-d020c24e42a68fb9f47fcf6e4c73654f wp-block-paragraph\">Indian courts have repeatedly held that a foreign divorce decree is not automatically enforceable in India. The Supreme Court of India in Y Narasimha Rao vs. Y. Venkata Lakshmi (1991) held that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-0f38ba526f770771dc2316af0b9e1491\">The foreign court must have proper jurisdiction<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3237d077adc049e718e6b753ffcdf509\">Both parties must have participated in the proceedings<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-956195dfed49cb2f1139e6dbb3ce32f4\">The divorce must be granted on grounds recognized under Indian matrimonial law.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-dfbb2280949b1a9b1bbe382edda5adf0\">The decree must be passed on merits<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d1474a30827030a97a257e5905727a65\">It should not be an ex-parte decision<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-4b1076c5f6f0194d462f1f40182e2c20 wp-block-paragraph\">If these conditions are not fulfilled, the marriage may still be considered valid in India even though a divorce was granted abroad. This creates serious legal problems, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-522c24395dcc42d797ebc8931745f92a\">In case the NRI have remarried without recognising their foreign divorce decree in India, the second marriage can be challenged as bigamy is a crime in India.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3392cd707675c2b88d93bfd16d6e2bd4\">Maintenance can be claimed by the spouse in Indian courts as well.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-60d2acd2486a2ccb11c8c779a487485f\">Property and inheritance disputes may arise in Indian jurisdiction.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-04b20baa5b87ac5eec4de6e900c572b6\">Child custody conflicts may arise.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-33e2b2a1b78b42096c56d6bb75f9a45c\"><strong>What is meant by \u201cRegistration\u201d of a foreign divorce decree?<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-6c44572a5c6cae0d64e8cc0778ad7edf wp-block-paragraph\">In India, there is no formal registration mechanism, like in a government office set up by the authorities, to register the foreign divorce decrees in India. Many NRIs think that registering a foreign divorce in India is the same procedure as in registration of marriage. Foreign divorce decree must be recognised in Indian courts to make the decree legally effective in India. For this NRI couple or spouse should file a petition in Indian court. Indian courts pass the final ruling recognising the foreign divorce in accordance with Indian law.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-0f728310b02c9994f48e5c04f01d9b5b wp-block-paragraph\">The parties usually file a declaratory suit in India for registration of a foreign divorce decree to seek:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2c2963e3932f179fea39a724671ff699\">Declaration that the foreign divorce decree is valid<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5dfc1034a909baedc8493ea9468b1b7e\">Execution of the foreign judgment<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-03f6844009c319b6b21cf024ace32719\">Fresh divorce in India if the decree is found invalid in India<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-498ae9f00f908e22db4b6b8ff3cb3695\"><strong>Complications when a foreign divorce decree is found Invalid in India<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-923b76baec63f9c2f3a8c0fa8731f1cb wp-block-paragraph\">If a foreign decree is found invalid in India, the marriage may still be considered legally valid in India. It will lead to several legal and practical complications for NRIs, such as:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-fca1b1c689222d2876649c5a4cb78020\"><strong>Risk of Bigamy \u2013<\/strong><strong> <\/strong>The most serious consequence is that the NRI may remarry abroad, believing that the divorce is valid, but in India, the first marriage may still be considered<strong> <\/strong>valid. The Supreme Court of India in Y. Narasimha Rao vs. Y. Venkata Lakshmi case held that a foreign divorce decree not satisfying Indian law will not dissolve the marriage in India.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-0fca66d079a49053cd4d3c7faa2c15b0 wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;This may lead to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-7e4bd182d522dc3c7dcddd67127da15a\">Criminal case for bigamy under the Indian Penal Code (IPC)<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-73b71d4364e162f6a040257924a5a788\">Second marriage is void in India<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-fd71443b4ffcf73c8b6877c8f7fd923e\">Issues in inheritance and succession\u00a0<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"559\" src=\"http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-09-at-9.00.28-AM-1024x559.png\" alt=\"Validating the Foreign Divorce in India \" class=\"wp-image-5806\" srcset=\"http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-09-at-9.00.28-AM-1024x559.png 1024w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-09-at-9.00.28-AM-300x164.png 300w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-09-at-9.00.28-AM-768x419.png 768w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-09-at-9.00.28-AM-1536x838.png 1536w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/04\/Screenshot-2026-04-09-at-9.00.28-AM-2048x1117.png 2048w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-def0b897e3e6af6a09d5b2e7d9422245 wp-block-paragraph\">Thus, an NRI who remarries after an invalid foreign divorce may face both civil and criminal proceedings in India.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e6cb2f359cb06c99376cb1f9e1d4ac79\"><strong>Maintenance and alimony claims can continue in India \u2013<\/strong><strong> <\/strong>Even after obtaining a divorce abroad, the spouse in India may file or continue maintenance and alimony proceedings under the Hindu Marriage Act, Special Marriage Act, Section 125 of the CrPC (now section 144 of the BNSS), Domestic Violence Act, or Indian Divorce Act.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e6d1099da4db7455af1f02fed8db00b9\"><strong>Child custody and Guardianship disputes \u2013<\/strong><strong> <\/strong>Foreign courts often decide child custody along with divorce, but Indian courts may not accept such orders if the divorce itself is invalid. This can result in:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d86a1df6078fdd88aa4d6ff86e06b5a4\">Parallel custody proceedings<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f8dac71192604b45514f02e79e1ad16e\">Conflicting orders from two countries\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2dfc418ecf6acbebde4c714d6c5253e6\">Difficulty in bringing the child to India<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5687ee566ad3e91d57e257362054d42e\">Passport and visa complications may arise<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-31ee3570079d9a1fc5cbe4e78ed4e826 wp-block-paragraph\">Indian courts may re- examine the custody of the child based on the welfare of the child, even if a foreign court has already passed an order.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5cbe5cf4294c730c449455db6b20086e\"><strong>Property and inheritance disputes \u2013<\/strong><strong> <\/strong>In many NRI cases, property located in India becomes subject to litigation because marital status is unclear, if a foreign divorce is not recognized in India:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-feda16311096363d5d537d800c54c1d5\">The wife\/husband may still be treated as legally married in India<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-7dfad9d7e25f1ec2ccfa3208097c2dd1\">Husband\/wife cannot transfer a property freely<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3c2767046a80d8fea2a19f422422eb50\">Succession rights of the spouse may remain active<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d05ae06d52ee947e53a345b431d1b408\">Family disputes may arise<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-f4f186820a7060d62f416b27db82e67e wp-block-paragraph\">This is common when a divorce is granted abroad without the participation of the spouse living in India.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f5052b4a6e31cd1d6a0f89c76e58b214\"><strong>Immigration and documentation problems \u2013<\/strong><strong> <\/strong>An invalid foreign divorce may cause issues in:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-930748e3e531bc591f7fc32759ac0a89\">Sponsoring a new spouse<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-858b4e75fa91a23a4e96b6f026cd9524\">Visa applications<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-18c0bde63c97be7a1bec615b5ac930ad\">Overseas Citizen of India (OCI)\/ Person of Indian origin (PIO) records<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-feaa5e938e81d9a4b901eae9e2aeefbf\">Passport marital status (Indian authorities may refuse to update the spouse details)<\/li>\n<\/ul>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-56618077079588183929e2a99a7ce160\"><strong>Emotional and financial burden on NRIs \u2013<\/strong><strong> <\/strong>Apart from legal complications, NRIs also face emotional and financial burden, such as:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9b914d4ac9684bd7b827bbefcb58dc64\">Long-distance litigation<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-61fec1fce4f249c7cfc4c8169cea9ef7\">High legal expenses in two countries<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f234cbe66fb9f4b1cbd3fd145453b41a\">Repeated travel to India<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3fe80d511ec5d8d2ce92955b5af1925f\">Delay in remarriage or settlement<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2dbc102b69bf9e65be16b5a5702125d4\">Stress due to multiple proceedings<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-11b1ea8bd0f91c549b51622daeace109 wp-block-paragraph\">In the case of Neeraja Saraph v. But the decree must be recognized by an Indian court before it can have legal effect in India (for example for remarriage, property disputes, maintenance claims, and child custody). The recognition mainly depends on section 13 of the Code of Civil Procedure, 1908.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-661478313dd7f528b468c4f1ff9b8135 wp-block-paragraph\">To get the foreign divorce decree recognized and registered in India, following steps should be followed:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-949bfe2576f8cd66ec19ed5d52181717\"><strong>Check validity \u2013<\/strong><strong> <\/strong>Before filing anything, it is important to verify whether the foreign decree satisfies the conditions of Section 13 of the Code of Civil Procedure (CPC). A foreign divorce will be valid in India only if:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ad3145b3c1de3192bcb5b3a89b48d8ea\">The foreign court had competent jurisdiction\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-76c3f91fbb5c95573c502b5f13a131f4\">Decree was given on merits<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ba3b236ce3a921b0d88ee713492d7b61\">Both parties were given fair opportunity (principle of natural justice)<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1b2e86d21b8f79ba45445916942106fb\">Grounds of divorce are recognized under Indian law<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8b7f8abbf8d2e53e9062b2ee3192938e\">Decree was not obtained by fraud\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-131f4134d1c57da247c4f99ed9d89b85\">Decree is not against Indian public policy<\/li>\n<\/ul>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-02c120c883e30e6569ff28a5e03e7d23\"><strong>Obtain a Certified Copy of the Foreign Divorce decree \u2013<\/strong><strong> <\/strong>the spouse must obtain the:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-797a86d3d14c14146cd02576219f0d02\">Certified copy of the divorce decree\/judgment from the foreign court<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-990694f6ecaf13ac15817d713a6b5ad1\">Apostille or consular attestation of that copy<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e3039f9d11395532b4573f065c775597\">If the country is a member of the Hague Convention, then only an apostille stamp is needed, it is a simplified form of authentication accepted internationally<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-07439992dfd23cb7c2deed2fe3904077\">If the country is not a member of the Hague Convention,
