Revision No. 512 of 2023<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-23f5961b3d1d441996ef5570fb752f92 wp-block-paragraph\"><strong>Chronology of events in the case:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8cd0d5b98f952939baf06f07f99cb5e3\">The wife (Sangeeta Toppo) filed an application under section 125 of the Code of Criminal Procedure seeking maintenance from her estranged husband<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9f1da0d81eb073b84974ab33162bbe4d\">The Family Court in Ranchi allowed her to claim and directed he husband to pay Rs.15,000 per month as maintenance<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1f276a0442fb692a4f0506782c66e2dc\">The husband (Amit Kumar Kachhap) challenged this order before the Jharkhand High Court.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f8cdc9c0bee361016380b8d1b83c2496\">The husband contended that the wife left the matrimonial home without any valid reason, which is why she is not entitled to claim maintenance under section 125(4) CrPC<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f4f898f9345c457528295515593a6f6d\">The wife contended allegations of cruelty, neglect and extramarital relationship by the husband<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c1aff2e42efa66fd487b33059e366241 wp-block-paragraph\"><strong>Judgment:<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-2f1f6d5ff34bd2de5bfe8040c746342a wp-block-paragraph\">The Jharkhand High Court allowed the husband\u2019s revision petition and held that a wife who is residing separately without any sufficient cause is not entitled to claim maintenance under section 125(4) CrPC. The court examined evidence from both sides and found that the wife failed to prove valid justification for leaving the matrimonial home. Her allegations lacked evidentiary support, so the court concluded that the wife was residing aloof from the husband without any reasonable cause and hence she is disentitled to claim maintenance. The maintenance order of granting Rs.15,000 per month was set aside by the court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-37700db7d9252edd9dcb2f32964e74d4\"><strong>Other conditions where maintenance is denied<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5308f8275ab8f1f801af5c9ae1021ff3\"><strong>Adultery \u2013 <\/strong>Under section 125(4) CrPC, a wife is not entitled to maintenance if living in adultery.<strong> <\/strong>It must be continuous adulterous conduct, not a one-time lapse, and the burden of proof lies with the other spouse. The principle is that maintenance is meant to support a legally recognised relationship, and continued adulterous conduct breaks the foundation of that claim.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-aca56f0460e022a42cdf6b505e0b84d7 wp-block-paragraph\"><strong>In the case of Kanchan v. Kamalendra AIR 1992, <\/strong>the Supreme Court of India clarified that adultery must be clearly proved through evidence and it must reflect a continuous course of conduct. Once established, it acts as a complete bar to maintenance.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2e5345df915d0c8b615979c3ff431d80\"><strong>Living separately by mutual consent \u2013 <\/strong>where both spouses agree to live separately, the element of neglect and refusal disappears. Section 125 CrPC is designed to protect a spouse who is neglected, not the one who voluntarily agrees to separation.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c45faba7c033a49c7eced2403a413ef2 wp-block-paragraph\">Thus, if separation is by mutual consent:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-a1dc096f7e110f5ccec23521662c15dc\">Maintenance may not be granted unless agreed upon by the parties<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-834b54e0235f9a8dc7df2e73846ecce3\">Courts treat it as a voluntary arrangement, not a legal wrong<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-f37396e41f1c6514c5492f44ed03f305 wp-block-paragraph\">If the spouse stops paying maintenance agreed in a mutual consent separation, then the other spouse can enforce the settlement through execution proceedings or claim maintenance independently, as such agreements are legally binding once recorded by the court.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-921b854e2ea37ffbd31758f691a4d1d4\"><strong>Financial independence \u2013 <\/strong>Maintenance is based on the inability to maintain oneself, not merely on the existence of the marriage. Courts closely examine whether the claimant is financially dependent or not. If the spouse has sufficient income or if the spouse is capable of earning and sustaining themselves, then the maintenance may be denied or reduced by the court.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c285511165b15cf615cf3d6412eb719e wp-block-paragraph\"><strong>In the case of<\/strong> <strong>Mamta Jaiswal v. Rajesh Jaiswal DMC170 (2000), <\/strong>the court held that an educated and capable spouse cannot deliberately remain idle. Maintenance is meant for support, not for creating dependency by choice.
