It informs the receiver that a legal proceeding has been initiated and their presence or response is required. It ensures that individuals involved in a legal matter are properly informed about the proceedings and given the opportunity to appear before the authority or court.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-4d36b3e324a2021742f9be7abae57119 wp-block-paragraph\">Summons helps to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-0869cc5cad8363ade3c83cef18aaa7da\">Ensure fair opportunity to be heard during a legal process.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-47aa4bd234d8952d09d2017817a56d97\">Notify parties about the legal proceeding involving them.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-7d062e111b38f787bab7fa18cc0142a4\">Ensure the presence of parties and\/or witnesses in the legal process to deliver justice.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who can issue summons?&nbsp;<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-96b81e08ab694121a7a5a2971fc9516a\"><strong>Courts<\/strong>: Courts are the primary authorities that can issue summons in both criminal and civil cases<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-dc3b86dc53a9a42ba42bdaa3a20239bb\">Civil courts: civil courts issue a summons to inform the defendant that a case has been filed against them and to require them to appear in court. The civil court has the power to send a summons under (the Order V of) the Code of Civil Procedure, 1908.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-6ec956357d24532eb47140e2afaed1a8\">Criminal courts: criminal courts issue summons in criminal proceedings where the presence of an accused or witness is required.<\/li>\n<\/ul>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-7e61f01bc1c4a16615c41117b54c4521\"><strong>Police Authorities:<\/strong> Police authorities have the power to issue a summons under the section 160, of the Criminal Procedure, 1973. A police officer investigating a case may require the attendance of any person who may have knowledge of the facts and circumstances of the case.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9fadac7d0542cedadf73991ee4f2d3c1\"><strong>Income Tax Authorities<\/strong>: Income tax authorities have power similar to civil courts for investigation and assessment. Under section 131 of the Income Tax Act 1961, income tax authorities can issue a summons<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9e1c0386a3708a9cd330694d3678fb2c\"><strong>Enforcement Directorate (ED):<\/strong> The Enforcement Directorate investigates the offences related to money laundering. Under section 50 of the Prevention of Money Laundering Act, 2002,\u00a0 the Enforcement Director office has the power to summon any person whose attendance is necessary during an investigation.<\/li>\n<\/ol>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1ea1b0915e982c5f2fef50997e22b949\">\u00a0<strong>Custom Authorities:<\/strong> A customs officer can issue a summons during investigations related to smuggling or customs duty violations. Under section 108, of the Customs Act 1962, a Customs officer may summon any person to give evidence or produce documents during an inquiry.<\/li>\n<\/ol>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-dd172aec4cc7aa67df15cb45b8874f5d\"><strong>Human Rights commissions:<\/strong> National Human Rights Commission of India (NHRC) and State Human Rights Commissions protect people&#8217;s fundamental rights. Under section 13, of the Protection of Human Rights Act, 1993, the Human Rights Commission has the power similar to a civil court; therefore, they can summon any person, call for documents or records, examine witnesses etc.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Service of the summons to the NRIs&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-0cf8af2c870ccdeab3e3968f25680a6b wp-block-paragraph\">For NRIs, receiving summons can be challenging because they live outside India. However, Indian law provides certain procedures to ensure proper service of summons.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"576\" src=\"http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/image-18-1024x576.png\" alt=\"\" class=\"wp-image-5747\" srcset=\"http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/image-18-1024x576.png 1024w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/image-18-300x169.png 300w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/image-18-768x432.png 768w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/image-18.png 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-512758894ff8a8cb0fb9de180192647e wp-block-paragraph\">Under the Code of Civil Procedures, 1908 summons to NRIs can be served through several methods, such as:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-4d04ab7da7b2103c74c4f6ddbc367412\"><strong>Through Embassy\/consulates<\/strong>: Indian embassies or consulates can serve summons to NRIs abroad. This method is often used when other methods aren\u2019t feasible.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-79e92d3812bd28cd8180e4b10f74ac2a\">It is a more official and reliable method of service of summons and it adds more legal credibility in the court.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c549f14f706332a107fb128cc6c7eebb\">It is helpful in the circumstance where the exact address or the direct contact to the person is difficult.\u00a0\u00a0<\/li>\n<\/ul>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-67d38f0d0bf565138204429a227be741\"><strong>\u00a0Through registered international post or courier:\u00a0 <\/strong>The court sends the summons along with copies of the case document to the person&#8217;s foreign address . It is the most commonly used method for the service of summons. It is an easy and cost effective method and provides a delivery proof and tracking receipt.\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-55eb12b1c992b7e3a22c4c685b671722 wp-block-paragraph\">However on the disadvantageous side this method fails if the address is wrong\/ person refuses to accept the delivery.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-fae8dcd909f7df53ec459214e14493b6\">\u00a0<strong>Through email or electronic forms<\/strong>: The court allows service of summons through email and electronic forms when the person involved resides outside India. This approach helps ensure that legal notices reach parties quickly and reduces delay caused by international postal procedures. However, a person may ignore or deny receiving the email and can have doubts about the authenticity of the summons.\u00a0\u00a0<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-52b89bb7936bf025ca92479f91578823\"><strong>\u00a0Hague service convention<\/strong>: If the NRI&#8217;s country is a signatory country like the US, UK, Australia, India can request service of summons through the country\u2019s central authority.<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-2c03e7603d9e92bd8d7ef1313758c817 wp-block-paragraph\">In case of NRIs it is the most effective method legally and is recognized and accepted by the foreign courts. However this&nbsp; process can take months of time as it is a more formal and complex procedure.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-black-color has-text-color has-link-color wp-elements-9aca103c82d6fa7629a7770918a5139e\"><blockquote><p>Note: This is not applicable if the country is not a part of the Hague convention.<\/p><\/blockquote><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-a490058f325ec425594827273183a7ef\"><strong>Benefit of Hague service convention<\/strong> for NRIs <\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a6ee1c897ea33fee53167db0b6c79a24 wp-block-paragraph\">The Hague service convention is an international agreement between countries that explains how legal documents, such as court summons and notices, should be delivered to people who are living in other countries. In simple terms, it is a system that helps the courts to send legal papers from one country to another in a proper and recognised way.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-12fdca61ad6ef450af7d1d4176f6f567 wp-block-paragraph\">The main purpose of the Hague Convention is to make the process of serving legal documents abroad simple, secure and internationally recognized. Before this convention existed, serving court documents across borders often required complicated diplomatic procedures. The convention created a uniform system so that courts in one country can send documents to another country through an official authority.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-293fbea3a7d9b3317894276cfa610eba wp-block-paragraph\">India officially ratified the Hague service convention on 23, November 2006, and it came into force in India from 1, August 2007.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-pullquote has-black-color has-text-color has-link-color wp-elements-7ae30ac5cd79986edb78aab08a1fa65a\"><blockquote><p>Note: More than 70 countries are part of Hague service convention, including Japan, the United States, Canada, Brazil, Australia, New Zealand, Germany, the United Kingdom, etc.<\/p><\/blockquote><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-536919ec5fa981f27abb24587d3c2bc8\"><strong>Procedure for summoning through Hague Service commission<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-b3b7da1f381dbba6eaa7568d0291eb29\"><strong>Court prepare summons:<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-e43ebf3b384e5e5c13022caa5eb34664 wp-block-paragraph\">The Indian court prepares summons along with the copy of the case and the Necessary documents. The court officials properly ensure that every document must be complete and signed properly.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5c4ca95b2c7b6d6cb274796a24cfea7e\"><strong>\u00a0Application is made for foreign service:\u00a0<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-e9b546653cc0a68cd9241e9598b10fd3 wp-block-paragraph\">The party that is filing the case requests the court to send summons abroad under this convention. This request is usually made under the provisions of the Code of Civil Procedure, 1908 (order 5 Rules 25-26A).<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-0abe3c2f537206fb99360b82ed1d165f\"><strong>\u00a0Documents sent to central Authority:<\/strong>\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-e13c86fedd2d4a35b5615d2161a11d65 wp-block-paragraph\">Every country under this convention has a central Authority, India sends the documents to the Central Authority of that foreign country in which summons are to be sent. This is done through official legal channels.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c8d4ba4023690d84d3538488b0f91438\"><strong>\u00a0Central Authority serves the summons:\u00a0<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-7e9edafb792e61f4940a05483141934b wp-block-paragraph\">The central authority of the foreign country receives the summons, and after checking if everything is correct, it arranges the service of the summons to the person (NRI) as per their local laws, such as through a court officer, through the local post service or through authorised agents etc.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3d1260694df9d5b0724e4f412545f1b1\">\u00a0<strong>Proof of summons is created:<\/strong>\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-69f1d279bb076d368def7cc8e242c6ea wp-block-paragraph\">After the delivery of the summons, the Central Authority prepares a certificate of service that includes details such as when the summons was delivered and how the summons was delivered.<\/p>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8d7a05f506e6cadb9023939b22463b9e\"><strong>\u00a0Certificate sent back to India: <\/strong>\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a810958030e6f98553c06314a6fe0571 wp-block-paragraph\">The certificate of service of summons is sent back to the Indian court. It acts as proof or official evidence that the summons was served properly.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>NRIs response to summons:&nbsp;<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"576\" src=\"http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/5-1024x576.png\" alt=\"\" class=\"wp-image-5751\" srcset=\"http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/5-1024x576.png 1024w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/5-300x169.png 300w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/5-768x432.png 768w, http:\/\/112.196.38.115:4294\/mycaremedical\/wp-content\/uploads\/2026\/03\/5.png 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-353876a0606992f7267070eec032ade1 wp-block-paragraph\">When an NRI receives a court summons from India, it does not mean that they must immediately travel to India. Indian law provides several practical ways to respond and participate in the case while living abroad.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c591cb08050b6c46f69c11e0a6398adc wp-block-paragraph\">Below are the main methods through which NRIs can respond to court summons:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ba9857dfe97e2efb4cd801613ec024cd\"><strong>Appointing a lawyer in India<\/strong>: The most common and practical step is to appoint a lawyer in India. A lawyer can represent the NRI before the court and handle the legal proceedings on their behalf. In many civil cases, the personal presence of an NRI is not required if a lawyer is representing them.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-964493cca966461465999730870311a3\"><strong>Granting the power of attorney<\/strong>:\u00a0 NRIs can authorize trusted persons in India, such as a family member or close relative, through a power of attorney. This person can sign legal documents, communicate with a lawyer, and attend court proceedings when necessary. Usually, the POA must be signed abroad and attested by the Embassy of India or a consulate in that country.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1fcd0ee6098ef0c0db1e937d2fc9702f\"><strong>Filling a written reply or written statement<\/strong>: After receiving the summons, the NRI must file a written reply to the court through their lawyer. The reply can clarify facts, deny allegations or propose settlement options.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-a69f906ee976684d2ba967f5389d2cea\"><strong>\u00a0Seeking exemption from personal appearance<\/strong>: NRIs can request the court to excuse them from personally appearing if travelling to India is difficult. The lawyer can file an application requesting exemption, explaining valid reasons such as living permanently abroad, work commitments, health or travel difficulties.\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-dbef4c5503c192e250516a68ceac02d0 wp-block-paragraph\">In Bhaskar Industries Ltd. V. Bhiwani Denim &amp; Apparels Ltd. (2001), the Supreme Court of India stated that courts may allow the accused to appear through a lawyer and grant exemption from personal appearance when justified.&nbsp;<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-a3b7470a2a7a9b4c0854465f04f54520\"><strong>\u00a0Participation through video conferencing:<\/strong>\u00a0<\/li>\n<\/ol>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-710537e7bc97f88ec88234a48c81defc wp-block-paragraph\">Indian courts allow participation in legal proceedings through video conference in many situations. This facility helps NRIs to attend hearings, give statements or record evidence without physically\u00a0appearing in court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-61d2957dd8a081fa4c244c7baa061646\"><strong>How NRI can attend court hearing online:<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-646c33c625d519444bfd096d52e9cab1 wp-block-paragraph\"><strong>Step 1<\/strong>: Application through a lawyer -The NRI&#8217;s lawyer files an application before the court requesting permission for video conferencing. The application must mention reasons such as residing abroad, travel difficulty, cost, etc.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-16db51395257b7ac2e8479bc88893ed4 wp-block-paragraph\"><strong>Step 2<\/strong>: Court permission-The court considers the nature of the case, the stage of the proceeding, the genuineness of the request, etc. If the court is satisfied, then the court grants permission to attend the court through video conference.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c3e49dee0096446bce2d1521c3f05541 wp-block-paragraph\"><strong>Step 3<\/strong>: The NRI must provide details such as Email ID, contact details, and identity proof, like a passport, etc. The court verifies identity before hearing<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-635d0204bc22d6c7ec1a1c50d19d5966 wp-block-paragraph\"><strong>Step 4<\/strong>: The court staff schedules a fixed date and time for the video conferencing and generates the link for the video<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-9ac08708d4dc6fef2fc11b47e7997225 wp-block-paragraph\"><strong>Step 5<\/strong>: The NRI has to join the video with a laptop\/mobile with a proper camera and internet with a stable connection, clear audio and visuals.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-3cfcc9742a09b01b201ad2f23b010aac wp-block-paragraph\">&nbsp;The legality of video conferencing in court proceedings was firmly established by the <strong>Supreme Court of India <\/strong>in the landmark case <strong>State of Maharashtra v. Praful B. Desai (2003). <\/strong>In this case, the court held that recording evidence through video conferencing is legally valid and falls within the meaning of presence in court under the Code of Criminal Procedure 1973. The court observed that modern technology can be used to make the justice system more efficient and accessible.
