The agreement allows the tenants to use the property for a fixed period of time(e.g.11 months, 3 years, 5 years, 9 years, etc.) in exchange they get rent or lease amount. In a lease agreement, the ownership of property does not transfer to the tenants.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Parties in a lease agreement:<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-3d645f94ee89c6ce89e4e5d69ef669c2 wp-block-paragraph\">There are two parties in a lease agreement; these parties are as follows:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2b522e76d41e9c63dc1040ce37fcf4dd\"><strong>LESSOR<\/strong>: The owner of the property is the lessor in the lease agreement. Once the agreed period ends, the lease automatically comes to an end unless both parties decide to renew it.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c8b70837b16bae307304e26ab59312ee\"><strong>Periodic lease<\/strong>: A periodic lease continues for repeating periods, such as month to month or year to year.\u00a0 It does not have a definite ending date and continues until either the landlord or tenant gives proper notice to terminate the agreement.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-133461f1f2353c677d2f82ac307e1a66\"><strong>Lease at will:<\/strong> A lease at will exists as long as both the owner and the tenant agree to continue it. There is no fixed duration, and either party can end the lease whenever they want to by giving notice.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2b85800ffc76bd30662144b415bfabd0\"><strong>Leasing by the Holder over:<\/strong> This type of lease arises when a tenant remains in possession of the property after the lease term has expired, and the landlord continues to accept the rent. In such a situation, the lease is treated as renewed, usually periodically.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-935d0c290895668189468db2a5937082\"><strong>Sub-lease<\/strong>: A sub-lease occurs when the original tenant transfers some part of the property or all of the leased property to another person for a certain time. The original tenant still remains responsible to the landlord unless the agreement states otherwise.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ca9cc021d9e91c88dcf83e41df5c3798\"><strong>Perpetual lease<\/strong>: A perpetual lease is granted for a very long duration with a right of continuous renewal. It allows the tenant to occupy and use the property almost permanently, although the ownership still remains with the original owner.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Rights of lessor(owner) of property:<\/strong><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-395c686533de6cc48ff86adece74d585\"><strong>Right to receive rent:<\/strong> the lessor has the right to receive the rent at the agreed time and place as mentioned in the lease the lease period expires, the lessor has the right to get back possession of the property from the lessee<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-6faaba1528037ae0406d563d1d2324a1\"><strong>Right to evict the lessee in case of breach<\/strong>: the lessor can evict the tenant if:<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-heading\"><strong>Important clause that should be mentioned in the Lease Agreement:<\/strong><\/h6>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e38a2e2ff5a7a0178e30564152c1f7ba\"><strong>Parties Name clause:<\/strong> The names of the parties should be mentioned in the lease agreement, who is the lessor and the lessee in the agreement, with document proofs (Adhaar card, Passport, etc).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color of Property<\/strong>: The purpose of use of the property should be clearly mentioned in the lease agreement. Restrictions related to the use of the property should also be written in the lease agreement<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-a0965f30e69a114be129ce39c09eb7be\"><strong>Sublease clause:<\/strong> If the owner wants to prohibit the tenant from subleasing the property to another person, the NRI must mention it in
