If any of the spouses is living abroad, he\/she does not need to come to India for filing a divorce or to be present in every court hearing. They can authorize a lawyer or trusted person in India to represent their case.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a3f1514d6317b5f9c7aea425a9de0617 wp-block-paragraph\">Here are a few steps that need to be followed when filing a divorce case through the Power of Attorney:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-eac1a510ce3258ee0388350a01978cd4\">The NRIs should take professional legal help in India to confirm the&nbsp; jurisdiction of the court. NRIs should ascertain what type of divorce they are filing, like if it is a contested divorce or a mutual consent divorce. For this, the NRIs should provide details such as:<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-29e679c29734ef3d649df334b6a39a78\">Place of marriage&nbsp;<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d5b03e248bf5e1804ea98fc1ba446f89\">Spouse\u2019s address<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e82361776fc19d0ccf9b2481b6c119ec\">The current address of the NRIs<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-710033250d4d7476cd9a960b927ba324\">Marriage certificate<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8ddec14ea6976877b2b62be47d718346\">Copy of passport<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9c3c6db2753ce7f5c33464fe98fdecff\">Whether both spouses have a mutual consent for divorce or it is a contested divorce.&nbsp;<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-08b0e58b4764a14068d7dd90c5597534\">The NRIs should prepare a Special Power of Attorney abroad not a General Power of Attorney. The Indian attorney holder must get the POA registered at the local deputy commissioner office to make it valid in India.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Mutual Consent divorce \u2013 the easiest option<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-b435469ab2e71f420a223d50de59c2b7 wp-block-paragraph\">If both husband and wife agree to get separated, then the simplest and easiest way is to file for a mutual consent divorce under Section 13B of the Hindu Marriage Act.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-b8d9d929c3ecd4e7eb2ef015d07da296 wp-block-paragraph\">A divorce is a mutual consent divorce, if :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f97b504386e1a6a016635aa0c3ed8527\">Both parties agree to end their marriage.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-597b60f7da9cab82d2a6524839b9a64c\">They must have lived separately for at least one year (according to Sec 13B of the Hindu Marriage Act,1955).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ef3de9fe72e26b579f226ebee0e1a093\">A joint petition for divorce should be filed in the court.&nbsp;<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-642896a09b949384747c88a02ca84e5a\">Statements are recorded by the court before the court grants divorce.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-f0cc53dbb2805f9f2a56407dfdbb28a5 wp-block-paragraph\">In many cases, the statements of NRIs are recorded through video conferencing or affidavit so that the NRIs may not need to come to India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-ed4a84f2a4e5ba33a70c8a04b24a1762\"><strong>Cooling \u2013 off period in a divorce case&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c2a6e15dc3dbdd8663566d41d1b70409 wp-block-paragraph\">Under section 13B of the Hindu Marriage Act, 1955, after filing the first motion for divorce, the parties were required to wait for six months before filing the second motion. This period is known as the cooling \u2013 off period and it was introduced to give time to the husband and wife to reconsider their decision and to see if reconciliation is possible.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-9ada98386b3abc82c892fbbac56d8652 wp-block-paragraph\">However, the Supreme Court of India in Amardeep Singh v. Harveen Kaur clarified that the six month cooling period is not mandatory in every case. The court held that if the marriage has completely broken down and there is no possibility of reunion then the family court may waive the waiting period to avoid unnecessary delay and hardship to the parties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contested divorce&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a74fca675b8d0d32885ab101631c5d91 wp-block-paragraph\">If one of the spouses or both the spouses do not agree for the divorce through mutual understanding, they can&nbsp; file for a contested divorce in India.
