This red line on the map was to separate the \u2018Habitation area of a Village\u2019, also referred to as Abadi area of a village, from the revenue earning agricultural area of a village in Punjab.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-b5cfd0326074e2de5455c36cd3c22f00 wp-block-paragraph\">In Punjab, the \u2018Lal Lakir\u2019 Act -Punjab Abadi Deh (Record of Rights) Act,2021, gives legal \u2018Property Rights\u2019 to the \u2018Residents of the villages in Punjab.&nbsp; With the introduction of the Punjab Abadi Deh (Record of Rights) Act, 2021, the government of Punjab has finally provided a statutory backbone for &#8220;Property Rights&#8221; within Lal Lakir areas by moving these properties from &#8220;possession only\u201d to a modernized legal framework within the revenue department. This transition is a seismic shift.<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-7e9a7b55184bc7bdcf2d58971b0f7dbb\"><strong>Can an NRI register his \u2018Lal Dora\u2019 Properties?<\/strong><\/h4>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-7a4b482708f3d41c74ebf89a832d81c8 wp-block-paragraph\">Yes, the Lal Dora properties can now be registered under the new scheme. Initially a certificate of ownership is being&nbsp; provided to the owners. Lal Dora lands were not registered earlier because they were out of the ambit of land revenue. It is recommended to contact the local revenue authorities to make sure your property ownership is clearly mentioned in the certificate. Once the process is completed and your property is free from any objections the authorities will issue the certificate of ownership.<\/p>\n\n\n\n<h4 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-b1770cd2df328049c73b2f06e9600d2e\"><strong> Uses of the LAL Dora certificate<\/strong><\/h4>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-94ec245b96db8b241e62432b6a3daa56 wp-block-paragraph\">Certificate of ownership of lal dora property ensures the legal right on the property. After the drone mapping the Survey team will conduct a door-to-door verification to match the digital draft with the physical possession holders of the plots and houses and seek confirmation about their ownership claims. Both the digital draft and physical verifications are marked and then published as a tentative map for public scrutiny.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-865fb98b7e21108e223c0895b0a865d1 wp-block-paragraph\">The public is given a total of 30 days of the time to raise their objections to the title ownership of the property, after&nbsp; the map is published for scrutiny. Once the objections are raised the district level land revenue authorities must clear the case of ownership within the next 30 days.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-13463178094ae229810fc0f7d92f8ea8 wp-block-paragraph\">3) Final land record: The authorities release the final digitised map of the village land record by assigning a particular number to each and every house or plot. This serves as the definitive digital record forming the basis for your legal Certificate of Ownership.&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-7bef09c75b059fee4d2db8bc5b51b54a wp-block-paragraph\">NRI can authorise a trusted friend\/relative\/or legal adviser with a valid power of attorney(POA) to complete the process of Lal dora certificate. NRI Legal World recommends a special power of attorney for a specific purpose instead of a general power of attorney giving away all the authorities to the sale and register the property. The dispute was over a 9-marla plot that the plaintiff said was originally jointly allotted to Chet Singh and Tota Singh in 1964. Later, Chet Singh allegedly relinquished his share to Tota Singh, and the defendant claimed this made them the owners of the entire plot.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-91eee8f0b601118a6fff853eac4d5a82 wp-block-paragraph\">COURT FINDINGS<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3f35b4e214bd17085c46c5a8cd31beae\">The court examined documentary evidence related to the allotment and possession of the plot within Lal Lakir<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-536791f1d6c9bcb9274e1725c77dbd9d\">Continuous possession and inheritance from the original allotment played a central role<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-72066ed0f5d0869fa4c75c425281a407\">The case illustrates that when land is shown in Lal Lakir, clear historical evidence and possession are essential to succeed in a civil suit for ownership\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-6c6106e3dc735acc2b5bfcdd7e63b472\">2. Harjinder Singh vs State of Punjab and others, Punjab and Haryana High Court, 2012<\/h4>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-fc271b79f1a671e02aff73d64981fe89 wp-block-paragraph\">In this writ petition the petitioner challenged a revenue\/gram<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-314ee4f09294d1ab54b3f3dbac7ed7d4 wp-block-paragraph\">panchayat over a land that was claimed to be within the Lal Lakir and a part of the abadi area in a village. The dispute was centred on whether the land was common village property (Shamilat deh).<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-64314bdca036fcda83a5593ef270b256 wp-block-paragraph\">Court\u2019s final decision was:&nbsp;<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-e7dfa219379bc03b5c2cca4c4f2cda04 wp-block-paragraph\">The high court remitted the matter to the authority to decide if the land actually falls within the Lal Lakir or Abadi Deh or if it is genuinely common village land under the statutory definition.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-753bd3297098f8a292d7c3f344947e1f wp-block-paragraph\">The case shows that:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Land within Lal Lakir is not automatically common village land<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-66cd5e32132302c342665c2120f1b25d\">The village or panchayat must prove actual common use or statutory status, not just rely on things like police reports<\/li>\n\n\n\n<li>The court won&#8217;t accept casual evidence like police reports to decide ownership in Lal Lakir.<\/li>\n<\/ol>\n\n\n\n<h1 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-4a7140097924e07ff18aef26e8724a69\"><strong>Important tips for NRIs<\/strong><\/h1>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-dc2ea2230164d954636870bd72b9d413\">NRI should make sure the power of attorney is specific, not general.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c15916c25566bf2a3807b9804f9e6f38\">The wording in the draft of power of attorney must clearly specify the powers given to the attorney holder while dealing with the property. Property details must be clearly mentioned.\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-139c686e839e9c9a0724d021a2d47a79\">Present the documentary evidence to prove your claim to ownership. NRI can also provide utility bills of the house like telephone bill, Electricity bill, etc.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d636dc5225998757fb932ce3c2c68b84\">\u00a0The Lal Dora certificate does not convey full ownership; you have to register later in the sub-register office<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-63bb7b0fe603cd48cff92b5fa9f3cf46\">The NRI should get information on what stage the Lal Lakir property registration scheme (MERA GHAR MERA NAAM) has reached from their neighbors in the village or from other sources.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-6c0464072bb9471a8cbc40a671e8e698\">The NRI can see the map of the land (LAL DORA) on the official website of the survey of India. ( if available)\u00a0<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-b97b458766fe24460e63ce235c60c500\">The NRI can send the application to the concerned authority (Deputy Commissioner, SDM, Tehsildar) to make the authorities aware about NRIs ownership right on the property with all the possible details, via a registered post or email.
